What is expungement?
Expungement is a court process that clears a criminal record, usually an arrest, a charge or a conviction, from public view. Once a record is expunged, in most situations you can legally answer that you were not arrested or convicted of that offense when applying for work, housing or school.
Every state sets its own rules. Some states destroy the record entirely; others seal it so only courts and certain agencies can see it. States also use different names for the process, such as expunction, record sealing, set-aside or dismissal. In North Carolina, for example, it is called an expunction.
What usually decides eligibility:
- The type and level of the offense (misdemeanor or felony, violent or non-violent)
- How much time has passed since you completed your sentence
- Whether all fines, fees and restitution are paid
- Whether you have any new or pending charges
- How many prior convictions or expungements are on your record
Federal Firearm Rights Restoration
Federal law bars most people with a felony conviction from owning or possessing a firearm. Under 18 U.S.C. § 925(c), a person under that bar can apply to the U.S. Attorney General for relief. If the Department of Justice finds that the applicant is not likely to act in a way that endangers public safety and that relief is in the public interest, it can restore the person’s federal firearm rights.
The application is detailed. The DOJ reviews your full criminal history, proof that every part of your sentence is complete, proof that restitution and fines are paid, fingerprints, and statements from people who know you.
